Terms of Service
1. Introduction and acceptance
These Terms of Service ("Terms") govern your access to and use of PixelAI, an online service operated by [Legal Entity Name] ("we," "us," or "our"). By accessing or using PixelAI—whether through our website, applications, or related interfaces—you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Operator / contact details
PixelAI is operated by [Legal Entity Name], registration no. [Company/Business Registration Number], with address at [Business Address].
General inquiries: support@pixelai.co.il. Legal or privacy notices may be sent to privacy@pixelai.co.il.
3. Eligibility and age requirements
You must be able to enter into a binding agreement under applicable law. If you use PixelAI on behalf of an organization, you represent that you have authority to bind that organization. The service is not directed at children; you must meet any minimum age required by law in your jurisdiction (typically at least 13 or higher where stricter rules apply).
4. Description of the service
PixelAI provides AI-powered image and video generation and editing tools. Users may submit natural-language prompts, upload images or other permitted files, configure settings (such as resolution, duration, or style), and receive generated outputs. Features, models, and workflows may vary over time. Processing may rely on third-party AI model and processing providers and cloud infrastructure as described in these Terms and our Privacy Policy.
5. Account registration and security
Access may require authentication through supported methods (such as social login). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at support@pixelai.co.il if you suspect unauthorized access.
6. Credits, payments, and packages
Certain features consume prepaid credits. Credits are purchased in packages through our checkout flow. Credit costs may vary by model, task type, resolution, duration, quality, audio options, and other parameters shown in the product before you submit a job. Credits have no cash value, are not transferable except as we expressly allow in writing, and are generally non-refundable except where required by law or as stated in our Refund & Credits Policy.
Payments are processed by third-party payment processors. We do not store full payment card numbers on our servers.
7. Failed generations and credit refunds
If a generation fails due to technical errors on our side or qualifying infrastructure failures, we may automatically refund the credits for that job where technically feasible, as further described in our Refund & Credits Policy. Refunds are not guaranteed for user errors, policy violations, moderation decisions, third-party refusals, or unsupported requests.
8. User inputs and generated outputs
You may upload prompts, images, audio, video, or other inputs permitted by the product. You retain ownership of your inputs subject to the licenses you grant below. Outputs are generated algorithmically and may be imperfect, incomplete, or unsuitable for your purpose. You are solely responsible for how you use outputs, including compliance with law and third-party rights.
9. License to process user content
You grant us and our subprocessors a worldwide, non-exclusive license to host, reproduce, process, transmit, and display your inputs and outputs solely to provide, secure, improve, and troubleshoot the service; comply with law; enforce policies; and create aggregated or de-identified analytics where permitted by our Privacy Policy. This license lasts for the period needed to fulfill those purposes.
10. Intellectual property and user responsibility
You represent that you have the rights necessary to submit your inputs and to use outputs as you intend. You must not use PixelAI to misappropriate trade secrets, circumvent licensing, or generate outputs that infringe intellectual property, privacy, publicity, or other rights. We may remove content or suspend accounts when we reasonably believe policies or law are violated.
11. Prohibited uses
You agree not to use PixelAI to violate law or our Acceptable Use Policy, including without limitation:
- Illegal activity, fraud, harassment, hate, or threats;
- Non-consensual intimate imagery, sexual exploitation of minors, or harmful sexual content;
- Malware, scraping or attacking our systems, or bypassing security or usage limits;
- Misleading impersonation or deceptive synthetic media where prohibited;
- Spam, phishing, or abusive volume intended to disrupt the platform.
See our Acceptable Use Policy for additional detail.
12. Third-party providers
We integrate third-party AI model and processing providers, cloud hosting providers, storage providers, authentication providers, payment processors, and analytics and monitoring providers. Their services are subject to their terms and privacy notices. We do not control third-party models and cannot guarantee specific results.
13. Availability, queues, and model changes
The service may experience downtime, maintenance, rate limits, or queues. We may modify, add, or retire models, parameters, or pricing with reasonable notice where practicable. We do not guarantee uninterrupted access or any particular model availability.
14. AI output limitations
Outputs may be inaccurate, biased, or inappropriate. You must evaluate outputs for your use case—especially in sensitive contexts such as legal, medical, or safety-critical applications. AI-generated media should be disclosed where required by law or platform rules.
15. Suspension and termination
We may suspend or terminate access for violations of these Terms, risk to the service or others, non-payment (where applicable), or legal requirements. You may stop using PixelAI at any time. Provisions that by their nature should survive will survive termination.
16. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (OR THE EQUIVALENT IN LOCAL CURRENCY), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
18. Indemnification
You will defend, indemnify, and hold harmless [Legal Entity Name] and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your inputs, outputs, misuse of the service, violation of these Terms, or violation of third-party rights.
19. Governing law and jurisdiction
These Terms are governed by the laws applicable to [Legal Entity Name] at [Business Address], excluding conflict-of-law rules. Courts located in that jurisdiction will have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where they cannot be waived.
20. Changes to these terms
We may update these Terms by posting a revised version and updating the "Last updated" date below. Continued use after the effective date constitutes acceptance of the changes for non-material updates where permitted by law. Material changes may require additional notice as required by law.
